  • 3 Vertragsschluss

Dezember, 2025.

  • 1 Scope and Contractual Parties

(1) These General Terms and Conditions (hereinafter referred to as “GTC”) apply to all contracts between Derma Contour UG, operating as Derma Contour Aesthetic & Beauty Salon (hereinafter referred to as the “Salon”), and the customer (hereinafter referred to as the “Customer”) regarding cosmetic treatments and services offered at the Salon premises at Hausinger Strasse 6, 40764 Langenfeld, and through the website www.dermacontoursalon.com.

(2) Customers within the meaning of these GTC are consumers within the meaning of § 13 of the German Civil Code (BGB).

(3) Deviating, conflicting, or supplementary general terms and conditions of the Customer shall only become part of the contract if the Salon expressly agrees to their validity in writing.

  • 2 Subject Matter of the Contract and Description of Services

(1) The Salon provides cosmetic treatments and services, in particular:

  • Facial treatments
  • Body treatments
  • Permanent hair removal (laser/IPL)
  • Permanent Make-Up
  • Tooth whitening
  • Other aesthetic and cosmetic treatments

(2) The specific service contents, prices, and treatment conditions are set out in the respective service description on the website, in the Salon’s price list, or during individual consultations.

(3) The Salon reserves the right to change treatment methods or devices, if necessary, provided that the treatment objective is not substantially impaired and the change is reasonable for the Customer.

  • 3 Conclusion of Contract

(1) The presentation of treatments on the Salon’s website or in the price list does not constitute a legally binding offer, but rather a non-binding invitation to submit an offer.

(2) An appointment is booked by:

  • Booking via the website
  • Booking via third-party platforms (e.g., Treatwell)
  • Telephone booking
  • In-person booking at the Salon

(3) The contract is concluded upon:

  • Confirmation of the appointment by the Salon, or
  • Commencement of the treatment

(4) The Salon is entitled to refuse customers without giving reasons, in particular if:

  • The desired appointment is unavailable
  • The Customer does not meet the required prerequisites for the treatment
  • There is an important reason in the person of the Customer for refusing treatment (e.g., medical contraindications)
  • 4 Prices and Payment

(1) The prices stated in the price list at the time of booking shall apply. All prices include statutory value-added tax.

(2) Payment for the treatment is generally made in cash at the Salon. Alternatively, we accept payments via online booking platforms such as Treatwell, which are processed in advance.

(3) For bookings via third-party platforms, the respective payment terms of those platforms apply in addition to these GTC.

(4) The invoice amount is due for payment immediately after completion of the treatment.

(5) The offsetting of counterclaims by the Customer or the retention of payments due to such claims is only permitted if the counterclaims are undisputed or have been legally established.

  • 5 Cancellation and Rescheduling Policy

(1) You may cancel or reschedule your appointment free of charge up to 24 hours before the scheduled appointment time.

(2) If you cancel less than 24 hours before the appointment, we reserve the right to charge 50% of the treatment price.

(3) In case of no-show without prior cancellation, the full treatment price (100%) will be charged.

(4) For appointments booked via third-party platforms, the cancellation terms of the respective platform also apply. Treatwell generally allows cancellations up to 24 hours before the appointment.

(5) The Customer may nominate a substitute person if they are unable to attend, provided that this person meets the requirements for the treatment.

(6) The Customer may prove that no loss or a lesser loss has been incurred by the Salon due to the cancellation. In this case, the cancellation fee shall be reduced accordingly.

  • 6 Treatment-Specific Risks and Customer Obligations

(1) Certain treatments, in particular permanent hair removal with laser/IPLPermanent Make-Up, and tooth whitening, are associated with specific risks. The Customer will be informed about these risks before the treatment begins and will give their express consent (informed consent). This information will be documented in writing and signed by both parties.

(2) Risks of Laser Hair Removal:

  • The treatment may cause skin irritation, redness, and swelling, which usually subside within a few hours to days.
  • There is a small risk of pigment changes (hyper- or hypopigmentation), especially with darker skin types or pre-existing sun tan.
  • In rare cases, blistering, scarring, or infections may occur.
  • The treatment is contraindicated in certain skin diseases, during pregnancy, or when taking photosensitizing medications.
  • The treatment is not suitable for red, light blonde, or white hair, as the laser targets melanin in the hair.

(3) Risks of Permanent Make-Up:

  • The treatment is a minimally invasive procedure involving the introduction of colour pigments into the skin.
  • Possible risks include allergic reactions to pigments or anaesthetics, infections, undesirable colour changes, or uneven pigment distribution.
  • Complete healing may take several weeks; the final colour intensity is only achieved after complete healing.
  • The result may be influenced by external factors such as sun exposure, skin aging, or certain skincare products.

(4) Risks of Tooth Whitening:

  • Temporary tooth sensitivity to temperatures is common and normal.
  • Gum irritation may occur if the whitening gel comes into contact with the gums.
  • The treatment is not suitable for tooth decay, exposed tooth necks, or untreated gum disease.
  • Tooth whitening only works on natural teeth, not on crowns, bridges, or fillings.

(5) General Risks:

  • Any treatment can cause unexpected skin reactions.
  • In case of existing skin conditions (e.g., neurodermatitis, psoriasis, active acne), the treatment may worsen the skin condition.
  • Temporary or permanent changes in skin sensitivity may occur.

(6) Customer Obligations:

  • The Customer is obliged to disclose all relevant health information (allergies, skin conditions, medication intake, pregnancy, pre-existing conditions, surgeries) completely and truthfully before the treatment begins.
  • The Customer is obliged to inform the Salon about changes in their health condition between the consultation and the treatment.
  • The Customer is obliged to diligently follow the aftercare and behavioural instructions provided by the Salon (e.g., sun protection, care of treated areas, avoiding sauna visits).
  • The Customer is obliged to allow before-and-after photos if necessary for documentation of treatment success (photos will only be stored with the Customer’s consent).

(7) Warranty of Success:

  • The Salon owes treatment with the required professional care. A specific treatment success is not guaranteed.
  • The effectiveness of laser hair removal may vary individually; no guarantee of complete or permanent hair removal is given. Multiple sessions may be necessary.
  • The colour stability of Permanent Make-Up may vary depending on skin type, sun exposure, and pigments used.
  • The result of tooth whitening may vary depending on the initial condition of the teeth.

(8) Limitation of Liability for Non-Compliance:
The Salon shall not be liable for damages resulting from the Customer’s failure to follow the information and behavioural instructions or from incomplete disclosure of health information.

  • 7 Bookings via Third-Party Platforms (e.g., Treatwell)

(1) The Salon offers the possibility to book appointments via the booking platform Treatwell.

(2) For bookings via Treatwell, the Treatwell booking terms apply in addition to these GTC. These can be viewed on the Treatwell website.

(3) The contract for the treatment is concluded directly between the Salon and the Customer. Treatwell acts as a commercial agent of the Salon in the mediation and acceptance of the booking.

(4) For payments processed via Treatwell, the respective payment and cancellation terms of that platform apply. The Salon is not liable for technical errors or failures of the platform.

(5) In case of discrepancies between these GTC and the Treatwell terms, the provisions more favorable to the Customer shall prevail.

  • 8 Hygiene Regulations and Health

(1) The Salon applies strict hygiene standards in accordance with the provisions of the Infection Protection Act (IfSG) and the accident prevention regulations of the professional associations.

(2) The Customer is obliged to disclose all relevant health information and allergies before the treatment begins.

(3) The Salon reserves the right to refuse treatment if:

  • The Customer shows signs of contagious skin conditions
  • There are contraindications to the treatment
  • The Customer provides false or incomplete health information

(4) The Customer has the right to inspect the Salon’s hygiene plan.

  • 9 Liability

(1) The Salon shall be liable for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence on the part of the Salon or its legal representatives or vicarious agents, in accordance with statutory provisions.

(2) In the event of slight negligence in the breach of essential contractual obligations (cardinal duties), the Salon’s liability shall be limited to the contract-typical, foreseeable damage.

(3) The Salon shall not be liable for treatment success or specific results. Treatment results may vary individually.

(4) Liability for damages from treatments that result from incomplete or incorrect disclosure of health information by the Customer is excluded.

(5) Liability for indirect damages is excluded.

(6) The provisions of the Product Liability Act remain unaffected.

  • 10 Data Protection

(1) The Salon processes the Customer’s personal data in accordance with the statutory provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Details can be found in the Privacy Policy.

(2) For bookings via third-party platforms, the Customer’s data is also processed by the platform. The Salon is not responsible for data processing by the platform.

(3) The Customer’s data is processed for the following purposes:

  • Appointment management and reminders
  • Performance of the treatment
  • Invoicing
  • Documentation of treatment success (with consent)
  • Information about further offers from the Salon (with consent)

(4) Health-related data will only be processed with the Customer’s express consent (Art. 9 Para. 2 lit. a GDPR).

  • 11 Right of Withdrawal for Consumers

(1) Consumers within the meaning of § 13 BGB have a statutory right of withdrawal for distance contracts in accordance with § 355 BGB.

(2) The right of withdrawal is 14 days and begins upon conclusion of the contract.

(3) Important exception: The right of withdrawal does not apply to contracts for the provision of services in connection with leisure activities if the contract provides for a specific date or period for the provision (§ 312g Para. 2 No. 9 BGB). Since our treatments are tied to a specific appointment date, the right of withdrawal expires with the provision of the service.

(4) The Customer will receive a separate cancellation policy in text form with the appointment confirmation.

  • 12 Copyright and Usage Rights

(1) The Salon retains all copyright and exploitation rights to the documents provided during consultation or treatment (e.g., information sheets, care instructions).

(2) Before-and-after photos and other recordings of the treatment remain the property of the Salon and will only be used for advertising purposes or documentation with the Customer’s express consent.

(3) The Customer may request the deletion of their photos at any time.

  • 13 Final Provisions

(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) The exclusive place of jurisdiction for all disputes arising from this contract shall be the Salon’s registered office in Langenfeld.

(3) Should any provision of these GTC be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that comes as close as possible to the economic purpose of the invalid provision.

(4) Amendments and supplements to these GTC shall be in writing.
